I have concerns with my upcoming DCFS case
Basically in short I was in a dv relationship, I have 2 children and unfortunately last year one of them was harmed by the father. I had documented abuse to me and the child for over a few months until I got new housing.
Which I then reported the abuse, I was instructed to do services, counseling, drug tests, parenting programs and dv programs. I was also not to have contact with the father, I was caught being around him 1 time previously
At my most recent court date (9/23) I was told to obey DCFS or I risk losing custody, I was just caught again. They were recording trying to get a glimpse of my ex's face to prove it was him but his face was covered by his hoodie and I am fairly certain they didn't get his face because he didn't look over at them (10/26) and my next court date is (11/04) and I haven't been able to reach my public defender despite numerous attempts. I need to know if I may lose custody of my children at the next hearing. I have been a nervous wreck since
AI Answer
our risk is real. Repeated contact with the father after a no-contact order is a serious compliance issue in DCFS cases. Courts focus on child safety and your ability to protect them. If DCFS believes you’re not following orders, they can seek increased supervision or temporary removal, but loss of custody is not automatic. Document services completed and show immediate compliance.
- No-contact violations are taken seriously
- Custody loss is possible but not automatic
- Proof of compliance matters now
