If a power line damaged my car roof from the renters rotted tree falling on it,who is liable for it
The next door neighbors have had a rotted tree falling in large sections over the last 2 weeks and they have contacted the rental company to let them know the last section was hanging over the power lines and have gotten no response about their concerns of the rest of the dead tree taking down the lines. Last night they witnessed after hearing cracking the tree fell again taking down power and cable lines down which also fell on the roof of my car causing paint chipping, scratches and dents. I called the property rental company and they told me they were not liable, I don’t feel I have to pay for neglect on their behalf
AI Answer
Likely the property owner/rental company. If they had notice the tree was dead and dangerous and failed to act, that’s negligence. The falling power line doesn’t shift blame if the tree caused it. Your auto comprehensive insurance may pay first and then pursue the owner (subrogation). Utilities are usually liable only if their equipment was defective.
- Prior notice = owner liability
- Renters/landlord responsible for hazardous trees
- Insurance may cover, then recover costs
